Al Armendariz, EPA Chief Ousted For "Crucifying" Energy Industry, Joins Sierra Club

When video surfaced earlier this year of EPA's regional administrator Al Armendariz comparing his strategy for regulating the oil and gas industry as the EPA's regional head to crucifixion, Republicans gladly accepted the former SMU professor's proffered head. Then, when they asked him to Washington to be pilloried in person, he had the audacity to stand them up in favor of the lefties at the Sierra Club.

We learned today that Armendariz might not have been giving Congress the finger so much as extending his hand to his future employer. The Sierra Club announced today that, come mid-July, Armendariz will join the environmental group as part of their Beyond Coal campaign.

Per the Sierra Club, "Dr. Armendariz will draw on his scientific expertise working on air, water, and climate science to help move Texas, Oklahoma and Arkansas off coal-fired electricity and toward an economy powered by job-generating clean energy sources such as wind and the sun."

As expected, the press release makes no mention of crucifixion. That's a tool of government bureaucrats, and Armendariz is at the Sierra Club now. No, this is jihad.

Three Ways Obamacare Could Change Retail ... - Business Insider

Retailers said they were "dismayed" after the Supreme Court upheld Obamacare yesterday.

Even though the law's been in affect for 17 months, retailers haven't made any moves to comply with the new regulations. They say that doing so will break the bank and keep them from earning profits.

But now that it's been upheld, there are three questions that retailers will be asking, according to the Retail Industry Leader's Association blog.

RILA's Christine Pollack says:

  1. Will the Administration thrust dozens of delayed rules onto employers with little regard for the challenges associated with such quick implementation?
  2. Will the Administration be emboldened by the Supreme Court?s decision and produce rules that ignore the costs and concerns employers have expressed about rigid employer-mandate rules?
  3. Will the Administration recognize the need to protect the crown-jewel of America?s healthcare system, employer-sponsored coverage, and preserve flexibility in the system that allows employers to design coverage options reflective of the needs of their workforce?

These are big concerns for the retail industry. Pollack says that retailers fear they'll be "overregulated" and unable to provide affordable healthcare at all.

Much of this fear revolves around the "Employer Mandate Tax," which doesn't take effect until January, 2014.?

So, retailers will have make a decision. They can either eliminate employee health plans after 2012 if the penalty is actually lower than what they'd have to pay for a health insurance plan, or pay for it themselves.

Either way, there will be costs. But even if retailers thought the Supreme Court would strike it down, many of the big retailers have been planning for the worst since the health care overhaul first came up.

House passes student loans, highway jobs bill

(AP) WASHINGTON - Both the House and Senate on Friday overwhelmingly passed legislation to salvage 2.8 million jobs, mostly in construction, and forestall a sharp increase in interest rates on college loans.

The measure cleared the House on a 373-52 vote and the Senate passed it 74 - 19. The compromise legislation came as lawmakers scurried toward a Fourth of July recess. The bill also aims at shoring up the federal flood insurance program.

The bill would spend more than $100 billion on highway and transit programs over two years. And it would also prevent a doubling of interest rates on new student loans, which was scheduled to go into effect Sunday.

A deal clearing the way for passage of the bill was reached after Republicans gave up their demands that the bill require approval of the contentious Keystone XL pipeline and Democrats gave way on environment protections.

The development came amid a legislative session that has brought considerable scorn to the institution as a "do-nothing" Congress.

The burst of legislating comes just four months before the November elections, giving lawmakers achievements to show off to voters who have increasingly held Congress in low esteem.

"It's a jobs bill," said Sen. Barbara Boxer, D-Calif., who led Senate negotiations on the transportation portion of the package. She estimated the bill would save about 1.8 million jobs by keeping aid for highway and transit construction flowing to states and create another 1 million jobs by using federal loan guarantees to leverage private sector investment in infrastructure projects.

Sen. Max Baucus, D-Mont., didn't wait for final passage of the measure to claim credit for a share of those jobs. A statement issued Thursday by his office touted the $400 million in transportation aid Montana would receive and the 13,500 highway jobs in his state the money would support.

"I worked hard to make sure Montana had a seat at the table and I'm proud that we were able to get the job done for Montana families," Baucus said.

In the bargaining that led up to an agreement on the package earlier this week, House Republicans gave up their demands that the bill require approval of the contentious Keystone XL oil pipeline and block federal regulation of toxic waste generated by coal-fired power plants. Democrats gave ground on environmental protections and biking, pedestrian and safety programs.

"Critical reforms in this legislation consolidate our transportation programs, significantly streamline the bureaucratic project process, encourage private sector participation in building infrastructure and give states more flexibility to spend limited highway ... resources where they are most needed," said Rep. John Mica, R-Fla., chairman of the Transportation and Infrastructure Committee.

The bill consolidates transportation programs and reduces the number of programs by two-thirds. It also revamps rules on environmental studies of the potential impact of highway projects, with an aim toward cutting in half the time it takes to complete construction projects. And the measure contains an array of safety initiatives, including requirements that would make it more likely passengers would survive a tour bus crash.

But Democrats and Republicans also found plenty to criticize in the transportation deal.

"At least it's not as bad as our Republican colleagues wanted," complained Rep. Earl Blumenauer, D-Ore., who has champion bike and pedestrian programs. "But make no mistake, it is not a bill to be proud of."

The bill would spend about $100 billion on federal highway programs over two years, but puts off the politically tricky decision on how to pay for them after that. The federal 18.4 cent-a-gallon gasoline and 24.4 cent-a-gallon diesel taxes are no longer enough to pay for current spending on highway and transit programs. And two commissions and an array of private sector experts have said the U.S. should be spending about twice as much or more on its transportation infrastructure as it does now.

But Congress and the White House have refused to discuss raising fuel taxes or an alternative long-term source of money. The federal trust funds that pay for highway and transit programs are forecast to be nearly broke by the time the bill expires.

"When the bill expires we face a high cliff from which the program could fall," said Erich Zimmerman, a policy analyst with Taxpayers for Common Sense.

The fuel taxes are not indexed for inflation and haven't been increased since 1993, so their buying power has steadily eroded. Also, cars and trucks today are more fuel efficient and the number of miles driven has flattened, resulting in less gas tax revenue. Since 2008, Congress has three times dipped into the national general treasury to borrow a total of $34.5 billion to keep transportation programs going.

Congressional leaders decided to roll the transportation and student loan legislation into a single bill because, in the short term, they were both being paid in part by changes in pension laws.

Congressional bargainers reached an agreement earlier this week on the $6 billion college loan portion of that bill that would avert a doubling of interest rates beginning Sunday on federal loans to 7.4 million students. The current 3.4 percent interest rate on subsidized Stafford loans would balloon back to 6.8 percent on Sunday under a cost-saving maneuver contained in a 2007 law.

The bill also extends the federal flood insurance program to protect 5.6 million households and businesses. It addresses a shortfall arising from claims after 2005's Hurricane Katrina by reducing insurance subsidies for vacation homes and allowing for increases in premiums.

Property Tax Receipts Remain Constant Despite Housing Price ...

Property taxes are an important source of revenue for state and local governments to finance services, particularly education.

And despite claims to the contrary, property tax payments continue to provide an outsized share of state and local tax collections.

From the first quarter of 2012 to the second quarter of 2011, approximately $471 billion of tax was paid by property owners. On this trailing four-quarter basis, the amount of property tax paid has remained approximately constant since the final quarter of 2010.

While there has been some decline in the share of total state and local tax collections?allocable to property tax receipts, the share remains high compared to historic norms. The average share for property taxes since 2000 is 32%, while the current share stands at 34.7%. Consequently, housing and other real estate owners are still paying a higher than average percentage of state and local government tax receipts.

This elevated tax burden is significant, especially when one considers the decline in housing prices since 2006 ? a decline that has led many to incorrectly conclude that property tax payments have also significantly fallen. According to the Case-Shiller national house price index, housing prices are down a little more than 33% over the last 5 years.

Yet the decline of property taxes paid from the peak is negligible thus far (1.2%). This means that the effective tax homeowners pay on their homes remains high.? Nonetheless, as assessments in some areas?catch-up to accurately reflect current market values of owner-occupied homes, property taxes are expected to decline ? but this has not happened yet in any significant way.

Taxes paid by homeowners and other real estate owners remain the largest single source of taxes for state and local governments. At 35%, property taxes represent a significantly larger share than the next largest sources: sales and gross receipt taxes and individual income taxes, each at 22%.

* Data footnote: Census data for property tax collections include taxes paid for all real estate assets (as well as personal property), including owner-occupied homes, rental housing, commercial real estate, and agriculture. However, housing?s share is by far the largest when considering the stock of both owner-occupied and rental housing units.

If you choose to wear a baseball cap, you should also protect your ears and the back of your neck by wearing clothing that covers those areas, using sunscreen with at least SPF 15, or by staying in the shade. The best time to do this self-exam is after a shower or bath. You should check your skin in a well-lighted room using a full-length mirror and a hand-held mirror. (AP) ? Web game maker Zynga is trying to turn its digital playground into an even more entertaining place, working to prove wrong investors who doubt that it can build a long-lasting business.

Zynga unveiled features Tuesday that include a network designed to provide the more than 290 million players of its games with the same tools, whether they are competing on Facebook's online social network, a mobile device or the company's own website.

The network is called "Zynga With Friends." That's a reference to one of Zynga's most popular games, the Scrabble-inspired "Words With Friends."

Zynga Inc. also previewed several new games, including a food-themed title called "ChefVille" and a virtual house-building experience called "The Ville." Those are the latest riffs on a franchise that began with "FarmVille" three years ago.

"These games have become something like hobbies for millions of people," Zynga CEO Mark Pincus boasted to reporters who came to the company's San Francisco headquarters for Tuesday's presentation.

The addictive allure of Zynga's free games helped establish the company as one of past decade's brightest Internet stars. Just five years after Pincus founded the company and named it after his dog, Zynga has more than 290 million users worldwide and is expected to generate $1.4 billion in revenue this year.

But investors are worried Zynga is running out of new ideas as it girds for fiercer competition. The strategy laid out Tuesday evidently didn't provide much reassurance.

After edging up earlier in the session on hopes for bigger news, Zynga shares fell 30 cents, or nearly 5 percent, to close Tuesday at $5.77. That's well below the company's initial public offering price of $10 six months ago. The IPO raised $1 billion, enabling Zynga to buy its San Francisco headquarters for $234 million earlier this year to accommodate the growth envisioned by Pincus.

The concerns dogging Zynga include its ability to keep churning out popular games, increasing competition from more experienced entertainment companies such as Walt Disney Co. and Electronic Arts. Inc., and a shift toward playing games on smartphones that is expected to fragment that industry.

Zynga, which already attracts about 22 million daily users on mobile devices, has been trying to establish itself as a gaming hub and lessen its dependence on Facebook for traffic and revenue.

Toward that end, Zynga began in March hosting some of its games on its own website. The Zynga With Friends network is meant to ensure some of the features on Zynga.com also are available to players when they are on Facebook or mobile devices.

The network is also being opened to other game makers in an attempt to encourage players to come to Zynga.com more frequently. That could create more opportunities for Zynga to sell advertising to supplement the sales of virtual goods that make its games more engaging. Those items bring in most of Zynga's revenue. Just 3.5 million, or about 1 percent, of Zynga's users buy virtual goods, underscoring the challenges facing the company as it tries to convert more of its audience into paying customers.

Advertising accounts for just 9 percent of Zynga's revenue. As part of its efforts to boost that figure, Zynga last week began to publish ads from Facebook on its own website.

Zynga probably wouldn't have thrived if not for Facebook's social network, where posts about players' progress on various games have become a common sight ? much to the consternation of many Facebook fans.

Facebook accounts for 85 percent of Zynga's traffic and 92 percent of its revenue.

Even Pincus' personal fortune is intertwined with Facebook's.

As one of Facebook's early investors, Pincus still owns 4.3 million shares in the social network that is currently worth about $140 million.

Pincus, 46, owns a much larger Zynga stake that is currently worth about $545 million. He whittled his Zynga holdings by selling 16.5 million shares for nearly $200 million in April when the company's stock was worth twice as much as it is now.

Do you ever tire of hearing that a Hollywood remake is in the pipeline, when the ink has hardly dried on the original script? Like "The Girl With The Dragon Tattoo", "Cell 211" and "Let The Right One In" before it, this is another that has had the green light for an English language version. It's easy to see why there would be interest in this as it's an exceptionally good thriller. I just don't see why it's necessary to have it redone. Roger Brown (Aksel Hennie) is a high-flying businessman who works as a headhunter. He scouts potential applicants for executive jobs. While interviewing them, he learns very useful information that leads him to his second source of income: a sideline in executing valuable art robberies. His extravagant and expensive lifestyle can't be funded by his headhunting job alone. One particular interviewee is Clas Greve (Nicolaj Coster-Waldau). He has all the credentials for a post that Brown needs to fill but he also has just inherited a piece of art that will cure all of Brown's financial woes - if he can just get his hands on it. As it turns out though, this art theft is not as simple as his previous ones and Greve is not as buttoned up as he makes out. As this film opens we are introduced to unlikely leading actor Aksel Hennie who has an appearance that resembles the love child of Christopher Walken and Steve Buscemi. He's not your average leading man and his character is not that appealing either. He's a self-centred weasel of a man that seems to lack any morals but you know that things are, not entirely, going to go to plan for this scheming, double-crossing thief and that's exactly what captures your attention and provides the hook in this adaptation of Norwegian writer Jo Nesbo's novel. Director Morten Tyldum is wise enough to play his cards when he needs them and wrings out the suspense, masterfully, at every turn. He mounts the tension slowly before staging one gripping scene after another. The unpredictability of the spiralling plot delivers genuine excitement, helped immeasurably by natural characters and performers. Hennie in particular, is absolutely brilliant and will no doubt become a household name after this (apparently he already is, in his native Norway). Kudos to screenwriters Lars Gudmstead and Ulf Ryberg. It's their tight, deliberately paced and unpredictable script that keeps you guessing and shows a good level of intelligence. Admittedly, I haven't read the novel but if I were author Jo Nesbo, I'd be very proud of the job that has been done here. When the headhunter becomes the headhunted, this film grips like a vice and refuses to let go. I've seen quite a few film's from Scandinavia over recent years and have been very impressed with the high standard they are delivering. This is no exception and a thriller that will definitely compete with the best of the year.

NATO to meet over Syria's downing of Turkish jet

NATO said it would meet to discuss member state Turkey's accusation that Syria shot down one of its warplanes in international airspace and not inside its own territory, as Damascus claims.

NATO said it would hold an emergency meeting on Tuesday following a request from Turkey that invoked Article Four of the alliance's founding treaty, which covers threats to member states' security.

Turkey has already acknowledged that its fighter jet might at some point have entered Syrian airspace. But after an initially cautious response, Ankara toughened its rhetoric on Sunday.

Turkish Foreign Minister Ahmet Davutoglu told Turkey's TRT television that at the time it was shot down, their plane was in international airspace, 13 nautical miles from Syria.

Syria had given no warning before opening fire, he added.

The fighter had been on an unarmed training mission to carry out a radar system test, and both pilots are still missing.

"The Syrians knew full well that it was a Turkish military plane and the nature of its mission," said Davutoglu.

"Nobody should dare put Turkey's (military) capabilities to the test," he warned.

"We will bring this affair before public opinion and international law in the name of Turkey's honour."

Syria has acknowledged shooting down the F-4 phantom jet after it violated its airspace, but insists it only identified it as a Turkish fighter after the fact.

"What happened was an accident and not an assault as some like to say," Syrian foreign ministry spokesman Jihad Makdissi told the Al-Watan pro-government daily on Sunday.

But UN Security Council member Britain warned that Syrian President Bashar al-Assad's regime "should not make the mistake of believing that it can act with impunity."

"It will be held to account for its behaviour," Foreign Secretary William Hague said.

US Secretary of State Hillary Clinton condemned a "brazen and unacceptable act" and promised US assistance in investigating the incident.

"It is yet another reflection of the Syrian authorities' callous disregard for international norms, human life, and peace and security," Clinton said in a statement.

Italy, another NATO member, also condemned Syria over the incident and Foreign Minister Giulio Terzi said they would "actively participate" in the NATO meeting.

In his comments to Al-Watan Sunday, foreign ministry spokesman Makdissi tried to pour oil on the troubled waters.

"Syria was merely exercising its right and sovereign duty and defence," he said.

"There is no enmity between Syria and Turkey, but political tension (exists) between the two countries."

Turkish-Syrian relations have been strained by Prime Minister Recep Tayyip Erdogan's outspoken condemnation of the Assad's regime's bloody crackdown, which activists say has killed more than 15,000 people since March 2011.

Already Saturday, UN chief Ban Ki-moon had expressed his "deep concern" about the incident, particularly about the "potential serious implications" for the region, spokesman Martin Nesirky said.

The fighting inside Syria claimed scores more lives on Sunday.

The official SANA news agency reported that regime troops had killed "dozens of terrorists" after engaging them as they attacked people in the Jabaliye neighbourhood of Deir Ezzor.

The Syrian government uses the term "terrorists" to describe the rebels.

The Syrian Observatory for Human Rights said at least 91 people had been killed on Sunday in Syria, including 59 civilians.

The Observatory also reported that following an attack on an artillery battalion in Aleppo, a number of soldiers had defected, taking with them a large quantity of weapons.

And it said that rebels had shot down a Syrian regime helicopter near the Jordanian border.

"This is one of the bloodiest weeks in the conflict," Rami Abdel Rahman, head of the Observatory, said.

"It's like we are in a war. Sometimes when two countries are at war, not even 20 people are killed a day. But now in Syria it has become normal to have 100 killed each day."

Australia on Monday announced fresh sanctions against Syria, restricting or prohibiting trade across entire sectors.

"The Assad regime continues to show its unwillingness to negotiate a ceasefire and bring an end to Syria's bloodshed," Foreign Minister Bob Carr said in a statement.

In an opinion piece for The Australian newspaper, Carr called for Moscow to take a lead role in forcing Assad out.

But there were reports that Russia was to try again to send a Russian ship to make a controversial delivery of attack helicopters to Syria.

A first journey ended after exposure by the US authorities led the ship's British insurer to withdraw cover.

But an unnamed Russian diplomat said the ship, the Alaed, would soon try again to deliver the aircraft.

Heidi Klum Gets Splashed on Big Apple Commercial Shoot

Things got wet and wild on the set of Heidi Klum?s new commercial shoot in New York City this afternoon (June 23).

The 39-year-old model got splashed while hailing a cab on Fifth Avenue in a blue trench coat matched with pumps, but kept her perfect coif for the new Schwarzkopf Taft Hair Spray ad campaign.

In other news, the ?Project Runway? host revealed the show?s newest poster on her Twitter page on Wednesday (June 20) sharing, ?Check out the new @ProjectRunway Season 10 poster on @peoplemag!?

The promo shot features Miss Klum flaunting her goods while lying in a pile of scissors and she was a bit shocked by the scene telling People, ?"I got to the shoot and I thought they'd add the scissors in editing afterward. But nope, they wanted me to lie down right in the middle of the pile!"

AT&T, Sprint, and T-Mobile Galaxy S3 all rooted, let the custom ROMs flow!

Although we?ve been praising Samsung for making the new Galaxy S3 available on all major US carriers at (around) the same time, unlike what happened with the S2 last year, the actual releases haven?t been that well organized.

And despite the fact that there are many US tech users still waiting to get their hands on the S3, the independent developing community has worked unbelievably fast and has already managed to post root methods for all three American carrier-branded S3s available.

Our good pal Chris Smith told you earlier today all about the Sprint root, a hacking method that also works smoothly on the T-Mo S3, and now the AT&T rooting pack is up for grabs as well. ?
